Regulations for the use of the UNISPORT services of the ZSGW of the Rhineland-Palatinate University of Technology Kaiserslautern-Landau (RPTU)

Status June 2024

These conditions apply to the UNISPORT subscription, the Sportscard Landau, the UNISPORT Kids subscription, the additional tickets and the paid UNISPORT workshops of the ZSGW.

1. conditions of participation

All university members (i.e. students, employees, etc.) at RPTU Kaiserslautern-Landau are entitled to use the UNISPORT sports facilities and to participate in the sports program. Free places are available for guests, subject to capacity.

Participation and use is only permitted with a valid access authorization. Holders of a UNISPORT subscription or UNISPORT-Kids subscription and any additional cards, a Sportscard Landau and day ticket holders are entitled to access. Access authorizations can only be purchased via the customer login of the ZSGW WebApp. The creation of a customer account is a prerequisite. The amount of the fee depends on the tariff group.

 

Proof of membership of a tariff group (status group) must be provided when entering the personal data in the customer account. Information on the amount of the fee can be found on the UNISPORT website. A subsequent reduction is not possible after the purchase has been completed. If the tariff group status is not verified, the user will be assigned to the then valid tariff group and the resulting difference plus a processing fee of €25 will be charged. The participant expressly reserves the right to prove that the damage incurred by UNISPORT is significantly lower or that the expenses saved by UNISPORT are significantly higher than the amounts or deductions taken into account above, or that the services have been used by third parties (e.g. subsequent participants). In the event of such proof, the participant shall only be obliged to pay the correspondingly lower amount.

 

A distinction is made between the following tariff groups:

Employees of cooperating institutions
Students of other universities Trainees
FSJ, BFD
Pupils
Children and young people up to the age of 18
People with disabilities (from 50% severe disability)
Pensioners

All other persons who cannot be assigned to the previous groups

 

By registering in the ZSGW WebApp, the user warrants that all data provided is correct and complete. If there is a change to the data provided after registration, the user is obliged to change the details in their customer account immediately. Students and employees at RPTU have the option of providing a recovery e-mail address if their university e-mail account is no longer accessible. If there is reason to suspect that third parties have knowledge of the access data or that misuse has occurred, users are obliged to inform the ZSGW immediately in writing or by e-mail.

 

In order to participate in the sports program, it is necessary to register for the respective course offer in the ZSGW WebApp.

 

Participation in the sports program is permitted from the age of 16. Children and young people under the age of 16 may only participate in UNISPORT events that are explicitly designated as children's and youth sports courses. Until the age of 18, all bookings requiring payment must be made via the customer account of a parent or legal guardian. All bookings that are not subject to payment can be made by users between the ages of 16 and 18 via the young person's own customer account linked to the customer account of a parent or guardian. If children and young people under the age of 16 use the sports grounds without taking part in a course, a person authorized to supervise them or another person of legal age to whom the duty of supervision has been transferred must be present. The declaration of consent of the legal guardian must be stored in the ZSGW WebApp and presented on request. The supervisors and legal guardians are responsible for ensuring that the persons entrusted to them comply with the rules of use and house rules. The supervisor is strictly prohibited from using the sports facilities independently if they have been granted free access to the facility to supervise a person under their care.

The prerequisite for participation is full fitness for sport. Playing sports under the influence of alcohol and/or drugs is prohibited.

Participants who persistently disrupt UNISPORT's activities despite a warning from the instructor may be excluded from the program. However, UNISPORT retains the right to the participation fee. The participant reserves the right to prove that UNISPORT is entitled to no or a lower participation fee in this case.

2 UNISPORT subscription

2.1 Purchase

The purchase of a UNISPORT subscription is possible for all status groups listed above.

UNISPORT subscriptions for young people between the ages of 16 and 18 can be purchased via the customer account of a parent or guardian. Children under the age of 16 can purchase a UNISPORT Kids subscription. This is done via the customer account of a parent or guardian.

The purchase of a UNISPORT subscription does not entitle the holder to participate in the offers at the Landau location.

2.2 Fees and due date

The minimum term of subscriptions is 6 months and can be terminated with three weeks' notice to the end of the minimum term. If the subscription is not terminated in due time at the end of the minimum term, it will be extended indefinitely. The subscription can be terminated at any time after the end of the minimum term with a notice period of three weeks. The calendar day on which the contract was first concluded is decisive for this. If the calendar day does not exist in the desired month of termination (e.g. leap year), the 1st of the following month is set as the termination date.

 

The respective fee is due semi-annually in advance. If the subscription is canceled after the minimum term has expired, a (pro rata) refund will be made in the amount of the amount that has already been collected beyond the end of the term.

Cancellation can be made in the customer account or via the web form provided on the UNISPORT website.

3 Sportscard Landau

The purchase of a Sportscard Landau is only possible for students and employees at RPTU. A UNISPORT subscription is not required. The purchaser is entitled to participate in the offer of the UNISPORT location Landau. A Sportscard Landau can be purchased for one semester at a time. The booking is made via the customer account. The Sportscard Landau loses its validity at the end of the semester in which it was booked. There is no automatic renewal.

4. additional card

4.1 Purchase

Additional cards must be purchased for some UNISPORT offers. Information on current additional cards and their conditions can be found on the UNISPORT website. The number of additional cards that can be booked per offer is limited per semester, depending on capacity. A valid UNISPORT subscription or Unisport Kids subscription is required to use the offers for which an additional card is required.

4.2 Fees and due date

An additional card can be purchased for one semester at a time. The booking is made via the customer account. The additional card loses its validity at the end of the semester in which it was booked. There is no automatic renewal. If there is no valid UNISPORT subscription or UNISPORT Kids subscription or if this subscription ends before the end of the current semester, the additional card also loses its validity. Further participation in the courses is not possible. The additional card may not be passed on to third parties.

5 Cancellation of courses

UNISPORT will inform participants immediately if a course is canceled or postponed. If the minimum number of participants specified by UNISPORT is not reached, UNISPORT will inform participants as early as possible. Measures that can be planned (e.g. closed periods, construction work, events) will be announced and communicated in good time.

6 Workshops

Participation in workshops is only possible after booking the respective workshop in the customer account. No UNISPORT subscription, UNISPORT Kids subscription or Sportscard Landau is required for registration and participation in workshops. The number of participants is limited depending on the type of sport.

6.1 Registration on the waiting list

If a workshop is already fully booked, registration is non-binding on the waiting list for the workshop. If a place becomes available for the workshop, UNISPORT will inform the person moving up by e-mail that the place has become available. If the place is not confirmed and paid for within 48 hours of the e-mail being sent, this is equivalent to withdrawing from the registration and no fees will be charged. If a place becomes available at short notice, i.e. less than 72 hours before the start of the workshop, due to the withdrawal of a participant, UNISPORT reserves the right to contact all persons on the waiting list. In this case, the place will be allocated to the person who confirms the place first. Payment by the person moving up will only be made once the place has been confirmed and payment has been requested by UNISPORT.

6.2 Withdrawal from a workshop registration

Cancellations can be made via the customer login of the ZSGW WebApp.

The following cancellation fees will be charged for the withdrawal of a binding registration:

A processing fee of €10 will be retained for each cancellation.

From 14 days before the start of the workshop, the participation fee will not be refunded.

The participant expressly reserves the right to prove that the damage incurred by UNISPORT is significantly lower or that the expenses saved by UNISPORT are significantly higher than the amounts or deductions taken into account above, or that the services have been utilized by third parties (e.g. subsequent participants). In the event of such proof, the participant shall only be obliged to pay the correspondingly lower amount.

6.3 Changes to services or withdrawal by UNISPORT

UNISPORT may cancel, postpone, change or relocate a workshop without notice if

 

  1. poor weather conditions make it impossible to carry out the workshop in the interests of the participants, taking into account the professional objectives.
  2. the professional guidance of the program cannot be provided by a UNISPORT trainer.
  3. the minimum number of participants specified by UNISPORT has not been reached after the registration deadline.

In such cases, UNISPORT will inform the participants immediately. In the event of complete cancellation by UNISPORT, participants will receive a full refund of the fees already paid.

7. day tickets

The offers of the UNISPORT subscription and the UNISPORT Kids subscription and some offers of the additional tickets can be purchased in the form of day tickets. Information on current day passes and their conditions can be found on the UNISPORT website. These are valid as access authorization for the day booked and end at the close of operations. The number of day tickets available for sale per day is limited. The amount of the fee depends on the tariff group of the purchaser.

8 Terms of payment

All payment transactions are collected via our payment partner ProCampus GmbH; no other form of payment is possible.

9 Liability

The liability of UNISPORT, in particular for damages resulting from a breach of contractual and/or statutory obligations, is limited to intentional and grossly negligent behavior. Notwithstanding the above limitation of liability, UNISPORT shall be liable for slight negligence for damages resulting from injury to life, limb or health, and for damages resulting from the breach of material contractual obligations. Essential contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely. The aforementioned limitations of liability shall also apply to employees, legal representatives and other vicarious agents of UNISPORT. UNISPORT, its employees, legal representatives or vicarious agents shall not be liable for accidents and damage incurred by the user as a result of self-inflicted accidents, injuries and illnesses during the use of the facilities and equipment.

 

Each participant is liable to the usual extent for any damage or loss caused by him/her intentionally or negligently. The conclusion of private liability insurance is strongly recommended.

10. insurance

Students and staff at RPTU Kaiserslautern-Landau are occasionally insured through the state accident insurance fund as part of UNISPORT courses in the sports program. However, every accident requires an individual assessment by the state accident insurance fund. Play groups without a permanent trainer are excluded from this. Accidents must be reported immediately to the ZSGW Service Center on an accident report form. A prompt assessment of the accident by a doctor is essential to ensure insurance cover. Courses that are used by purchasing an additional card or in the form of a workshop are not insured by the National Accident Insurance Fund. Participants in other status groups (see above) are generally not insured and are therefore responsible for their own insurance cover.

11 Use of photographic material

UNISPORT is entitled to use image and video recordings during the offers for public relations purposes (on websites, in social media and in print media). This consent can be revoked informally at any time.

12. consumer dispute resolution

With regard to the law on consumer dispute resolution, UNISPORT points out that UNISPORT does not participate in voluntary consumer dispute resolution. If consumer dispute resolution becomes mandatory after these terms and conditions go to print or UNISPORT participates voluntarily, UNISPORT shall inform consumers of this in an appropriate form. For all contracts concluded in electronic legal transactions, reference is made to the European online dispute resolution platform
